1. Acceptance of Terms

Welcome to AirPrice. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AirPrice ("Company," "we," "our," or "us") governing your access to and use of the AirPrice website, services, and applications (collectively, the "Service").

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

AirPrice provides AI-driven pricing intelligence and market analysis for short-term rental property hosts. Our Service includes:

• Personalized pricing recommendations based on comprehensive market analysis
• Competitor price monitoring and insights
• Tailored market trend reports and strategic guidance
• Availability and demand analysis
• Customizable alerts and notifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Operate a legitimate short-term rental property business

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

4.1 OAuth-Only Authentication

To access the Service, you must create an account using one of our supported OAuth providers:

• Google Account
• Microsoft Account
• Facebook Account
• LinkedIn Account

We do not create, store, or manage passwords. All authentication is handled securely through these trusted third-party providers using industry-standard OAuth 2.0 protocol.

4.2 Account Information

When you sign up via OAuth, we receive the following information from your chosen provider:

• Name
• Email address
• Profile picture (optional)

You agree to ensure that this information is accurate and current. If your email address changes, please update it through your OAuth provider.

4.3 Account Security

You are responsible for:

• Maintaining the security of your OAuth provider account (Google, Microsoft, Facebook, or LinkedIn)
• All activities that occur under your AirPrice account
• Notifying us immediately of any unauthorized access to your AirPrice account
• Using strong security practices with your OAuth provider (e.g., enabling two-factor authentication)

Important: You can revoke AirPrice's access to your OAuth account at any time through your provider's security settings. This will prevent you from accessing our Service until you re-authenticate.

4.4 One Account Per User

Each user may maintain only one account. Creating multiple accounts using different OAuth providers may result in termination of all accounts.

5. Subscription and Payment

5.1 Subscription Plans

AirPrice offers various subscription plans as detailed on our Pricing page. Each plan includes specific features and report frequencies.

5.2 Pricing

All prices are stated in Euros (EUR) unless otherwise specified. Prices are subject to change with 30 days' notice to existing subscribers.

5.3 Payment Terms

• Subscriptions are billed annually in advance
• Payment is due immediately upon subscription
• We accept major credit cards and other payment methods as indicated
• All payments are processed securely through third-party payment processors

5.4 Early Adopter Offer

We are currently offering 6 months FREE to early adopters (limited availability). No credit card is required during the trial period. We will notify you before the trial period ends and before any billing begins. You can cancel at any time during the trial period with no charges.

5.5 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee.

5.6 Cancellation and Refunds

• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
• Refunds: We offer a 30-day money-back guarantee for annual subscriptions. Refund requests must be submitted within 30 days of the initial purchase.
• Pro-rata Refunds: No pro-rata refunds are provided for mid-term cancellations after the 30-day guarantee period.

5.7 Failed Payments

If payment fails, we will attempt to charge your payment method multiple times. If payment continues to fail, your account may be suspended or terminated.

5.8 Taxes

You are responsible for all applicable taxes. If we are required to collect or pay taxes, they will be added to your invoice.

6. Acceptable Use of Service

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

6.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on our or others' intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the Service
• Use automated tools (bots, scrapers) without permission
• Resell, redistribute, or sublicense the Service
• Use the Service for competitive analysis or to build a competing product
• Submit false or misleading information
• Harass, abuse, or harm other users
• Overload or interfere with the Service's operation

6.3 Data Accuracy

You are responsible for ensuring that all property information you provide is accurate and up-to-date. We are not liable for inaccurate recommendations resulting from incorrect data.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including all content, features, functionality, software, algorithms, text, graphics, logos, and trademarks, is owned by AirPrice and protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business use, subject to these Terms.

7.3 User Content

You retain ownership of any data or content you submit to the Service. By submitting content, you grant us a worldwide, royalty-free license to use, store, and process that content to provide the Service.

7.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property, and we may use them without compensation or obligation to you.

8. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

9.2 No Guarantee of Results

While we strive to provide accurate pricing recommendations, we do not guarantee:

• Increased revenue or bookings
• Accuracy or completeness of market data
• Uninterrupted or error-free service
• That the Service will meet your specific requirements

9.3 Independent Decision Making

Our recommendations are informational only. You are solely responsible for your pricing decisions and their outcomes. We are not liable for any losses resulting from following our recommendations.

9.4 Third-Party Content

We are not responsible for the accuracy, legality, or content of third-party data sources or external websites linked from our Service.

9.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRPRICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless AirPrice, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at airprice.support@gmail.com or through your account settings.

11.2 Termination by Us

We may suspend or terminate your access to the Service:

• For violation of these Terms
• For fraudulent or illegal activities
• For non-payment
• At our sole discretion, with or without cause

11.3 Effect of Termination

Upon termination:

• Your right to access the Service immediately ceases
• We may delete your account data after a reasonable period
• You remain liable for all charges incurred before termination
• Provisions that should survive termination will continue to apply

12. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes.
